We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. Studies on informed consent to medical research conducted in low or middle-income settings have increased, including empirical investigations of consent to genetic research. We investigated voluntary participation and comprehension of informed consent among women involved in a genetic epidemiological study on breast cancer in an urban setting of Nigeria comparing women in the case and control groups.

An accessible guide to philosophy, presenting a collection of 70 essays covering the major themes, theories and arguments of the most prominent thinkers of ancient Greece.

In the last five years, a number of U.S. companies have either moved their locus of incorporation to countries with more favorable tax laws, or announced such moves. Given this trend toward “inversions”, and the polemics that have accompanied it, we offer two ways in which the ethics of such a move can be evaluated. We provide multinational executives with two applications of ethics to inversion: Kant’s deontological theory and the consequentialist perspective of utilitarianism.

O BIODIREITO E A DESILUSÃO DA BIOLOGIA DE MICHEL FOUCAULT.

Purpose/methods: This study investigated the relationship between ethics education and training, and the use and usefulness of ethics resources, confidence in moral decisions, and moral action/activism through a survey of practicing nurses and social workers from four United States (US) census regions. Findings: The sample (n = 1215) was primarily Caucasian (83%), female (85%), well educated (57% with a master's degree). no ethics education at all was reported by 14% of study participants (8% of social workers had no ethics education, (...) versus 23% of nurses), and only 57% of participants had ethics education in their professional educational program. Those with both professional ethics education and in-service or continuing education were more confident in their moral judgments and more likely to use ethics resources and to take moral action. Social workers had more overall education, more ethics education, and higher confidence and moral action scores, and were more likely to use ethics resources than nurses. Conclusion: Ethics education has a significant positive influence on moral confidence, moral action, and use of ethics resources by nurses and social workers. (shrink)

O presente estudo argumenta que, para Hobbes, a retórica constituiu-se como um importante aparato linguístico e conceitual disponível em seu tempo, sobretudo para a descrição dos fenômenos físicos na ciência experimental nascente no contexto do século XVII inglês. Considerando que os parâmetros epistêmicos na descrição desta ciência estavam por se desenvolver, Hobbes buscou soluções nas doutrinas das artes do bem falar, a começar em sua antropologia. A noção de conato em Hobbes indica o peso da tradição retórica clássica em sua (...) filosofia, com destaque para Aristóteles, os estoicos e Quintiliano. Veremos como a retórica, articulada à física e à ética, constituiu um relevante paradigma de expressão e de investigação de Thomas Hobbes sobre o conato e vai além do ornamento do texto em seu estudo sobre os corpos. Nossa pesquisa resgata a identidade aprendiz da criança portadora de paralisia cerebral frente à urgência da sua construção motora e busca estabelecer os fatores que participam desta construção motora reconhecendo a criança não apenas pela falta dos movimentos, mas, como um sujeito singular e subjetivo. Assim investigamos a história clínica da paralisia cerebral e a colocamos diante das histórias de vida relatadas por portadores de paralisia cerebral e por suas mães, pois, entendemos que o processo de construção motora mescla-se a (...) uma série de fatores que vem a inferir no desempenho motor da criança. Realizamos uma pesquisa de campo com seis crianças portadoras de paralisia cerebral e com suas mães, Nossa metodologia foi de caráter qualitativo com enfoque no trabalho terapêutico e nas entrevistas com as mães. Desta forma foi possível traçar uma relação entre desempenho motor, cognição, afetividade, aspectos clínicos, sociais e históricos da deficiência. (shrink)

O campo interdisciplinar dos novos estudos sociais das infâncias parte de uma ruptura epistemológica com as abordagens clássicas das ciências que adotam visões biologizantes, essencialistas e universais da criança e encontra na etnografia uma possibilidade de conceituação de criança enquanto sujeito ativo e de infância enquanto categoria social geracional. O reconhecimento desses conceitos de criança e de infância pela etnografia na pesquisa com crianças implica voltar-se para a criança como o outro, o diferente, o estrangeiro. A proposta de ruptura teórico-conceitual (...) na investigação das infâncias exige a implementação de metodologias que focalizem as experiências, os pontos de vista e as vozes das crianças, compreendendo-as enquanto processo, em outras palavras, constante construção. Portanto, para essa perspectiva, a criança não é o objeto do estudo, mas é sujeito que interage com o pesquisador na construção dos sentidos e significados da pesquisa. O texto está organizado em três partes que abordam os aspectos epistemológicos, teórico-conceituais e metodológicos do debate proposto. Ao final, procura-se uma articulação entre os diferentes aspectos da discussão, propondo uma reflexão sobre a ética e a alteridade, reconhecendo que a diferença atravessa as relações humanas e, portanto, é o diferente, o incomum, o incompreensível, o oposto, o desigual, o inalcançável que marca e define a pesquisa com criança. We consider weighted o-minimal hybrid systems, which extend classical o-minimal hybrid systems with cost functions. These cost functions are “observer variables” which increase while the system evolves but do not constrain the behaviour of the system. In this paper, we prove two main results: optimal o-minimal hybrid games are decidable; the model-checking of WCTL, an extension of CTL which can constrain the cost variables, is decidable over that model. This has to be compared with the same problems in the framework (...) of timed automata where both problems are undecidable in general, while they are decidable for the restricted class of one-clock timed automata. o objetivo deste artigo é discutir a aproximação teórica entre duas vertentes distintas de pensamento que, inicialmente, pode parecer improvável: a psicanálise e o marxismo. O texto discorre sobre a reflexão da gênesis do problema político, interpretando sociedade e indivíduo como inter-relação da natureza humana, conectando, a partir desse princípio, o problema político e o problema psicológico, este se situando como base original daquele. Portanto, no entrecruzamento de sociedade, poder político e natureza humana, expande-se um campo de investigação que se (...) abre a diversas possibilidades, inclusive à aproximação teórica entre as ideias de Marx e Freud. Dentre diversos autores que discutem o freudomarxismo e o posicionamento de Sigmund Freud, diante das ideias de Karl Marx, será dada exclusividade a Wilhelm Reich, Herbert Marcuse e a Ludwig Marcuse. Para uma crítica às ideias de Herbert Marcuse e análise da inter-relação entre marxismo e psicanálise, por sua vez, recorre-se ao filósofo marxista Louis Althusser e a outros analistas e críticos dessas mesmas ideias. The recent Supreme Court decision upholding Roe v. Wade and in particular, the dissent by Justice Sandra Day O'Connor, sheds new light on the issue of abortion. Let us consider any stage of a pregnancy when abortion is medically safe for the mother. If at that stage it is also medically viable to save the fetus, is an abortion performed at that stage of pregnancy morally justifiable? For example, if it is, or becomes, medically safe to perform abortions after first (...) trimester of pregnancy and at the same time saving a fetus is, or becomes, medically viable or not unusual during some stage of the second trimester, can abortions during and after that stage of pregnancy be justified? With a number of qualifications I shall argue the thesis that as a general rule, but not an absolute rule, abortion in these instances is not usually justifiable. For if it is, then one will also have to grant the moral justification for a number of other highly questionable medical practices. This thesis is not to be identified with the stronger claim that abortions of viable fetuses can never be performed. There are surely exceptions such as when the life or health of the mother is in danger. But, I shall argue, the justification for making such exceptions is on different grounds than is sometimes claimed because one must weigh the health of the mother against the life of another human being. O RECONHECIMENTO DA FAMÍLIA ANAPARENTAL COMO ENTIDADE FAMILIAR ESTÁVEL E SUA CONSEQUENTE LEGITIMIDADE PARA PLEITEAR ADOÇÃO, À LUZ DA JURISPRUDÊNCIA DO STF.

BackgroundReports suggest that some health care personnel fear retaliation from seeking ethics consultation. We therefore examined the prevalence and determinants of fear of retaliation and determined whether this fear is associated with diminished likelihood of consulting an ethics committee.MethodsWe surveyed registered nurses (RNs) and social workers (SWs) in four US states to identify ethical problems they encounter. We developed a retaliation index (1–7 point range) with higher scores indicating a higher perceived likelihood of retaliation. Linear regression analysis was performed to (...) identify socio-demographic and job characteristics associated with fear of retaliation. Logistic regression analysis was performed to determine whether fear of retaliation was associated with less likelihood of seeking consultation. Results Our sample (N = 1215) was primarily female (85%) and Caucasian (83%) with a mean age of 46 years and 17 years of practice. Among the sample, 293 (48.7%) RNs and 309 (51.3%) SWs reported access to an ethics consultation service. Amongst those with access, 2.8% (n = 17) personally experienced retaliation, 9.1% (n = 55) observed colleagues experience retaliation, 30.2% (n = 182) reported no experience with retaliation but considered it a realistic fear, and 50.8% (n = 305) did not perceive retaliation to be a problem. In logistic regression modeling, fear of retaliation was not associated with the likelihood (OR = 0.64; 95% CI = 0.22–1.89) or frequency of requesting ethics consultation (OR = 0.81; 95% CI = 0.27–2.38). Conclusion Fear of retaliation from seeking ethics consultation is common among nurses and social workers, nonetheless this fear is not associated with reduced requests for ethics consultation. Meu objetivo é elucidar o significado e os argumentos da perspectiva de Dionísio sobre o possível conhecimento de Deus através das procissões ou energias. Este conceito será crucial para o desenvolvimento da filosofia hesicástica do século XIV. A interpretação (...) correta do Corpus Areopagiticum será um dos principais tópicos de discussão entre Gregório Palamas e Barlaão, o Calabrês. Palamas evoca a noção de Dionísio Areopagita de “procissões” para fundamentar a distinção entre essência e energias em Deus. Estas πρόοδοι são a “extensão” de Deus fora de si mesmo; são várias, distintas umas das outras e não criadas. (shrink)

Resumo: O presente estudo procura construir novas hipóteses interpretativas sobre a gênese do poder civil em Thomas Hobbes, a partir do estudo da passagem clássica do estado de natureza para o estado civil. Consideramos que tal passagem, para além das interpretações canônicas, é um topos, encontrado na tradição retórica, especialmente em Cícero, em seu De inventione. Neste contexto, o discurso eloquente aparece como elemento originário e fundamental do Estado civil. Tal apropriação por parte de Hobbes emerge dentro de uma perspectiva (...) que trata a arte retórica como fonte de conhecimento, sobrepondo a questão do ornato da linguagem, de modo a compor um importante elemento dentro de sua concepção de poder civil. Leo Strauss defende o resgate do direito natural em sua obra Droit Naturel et Histoire . Entretanto, a defesa do direito natural implica o combate de algumas formas de pensamento já arraigadas na sociedade hodierna como: o historicismo e o positivismo. Além delas, Strauss também diverge do pensamento que defende a neutralidade da concepção de valores. O objetivo do presente trabalho é traçar algumas considerações sobre o direito natural no pensamento de Leo Strauss, tendo como principal fonte teórica a obra (...) já mencionada. Tratarei, primeiramente, da caracterização do direito natural. Após, analisarei a crítica dos opositores desse conceito. E, por fim, tratarei do significado do direito natural na atualidade.
